SECTION 1 — WHAT THE PLATFORM IS (AND IS NOT)
─────────────────────────────────────────────────────────────────────────────

1.1 PLATFORM ONLY — NOT A SELLER
The platform (Sivasbazar, operating under the app name HelernexMkt) is a
TECHNOLOGY PLATFORM ONLY. The platform, its developer (Praveen Pushkin),
and any associated parties are NOT:
• Sellers or resellers of any product
• Buyers of any product
• Delivery service providers
• Payment handlers or processors
• Manufacturers, distributors, or suppliers
• Quality inspectors of any product
• Legal representatives of any vendor or customer
• A party to any transaction between any vendor and any customer

The platform provides technology tools only, connecting independent
vendors with customers. Nothing more.

1.2 NO COMMISSION
The platform does NOT take any commission, fee, or payment from any
transaction between any vendor and any customer. The platform is free to use.

1.3 CASH ON DELIVERY ONLY — PLATFORM NOT INVOLVED
All product purchases are made by Cash on Delivery — directly between the
vendor and the customer. The platform is NOT involved in any payment.
The platform does NOT collect or handle any money at any time.

1.4 VENDOR ONBOARDING
Vendors may register and list products on the platform without prior
manual review or approval. The platform does not vet, verify, or endorse
any vendor before they begin selling.

SECTION 2 — DISPUTES: VENDOR AND CUSTOMER ONLY
─────────────────────────────────────────────────────────────────────────────

2.1 ALL DISPUTES ARE BETWEEN VENDOR AND CUSTOMER ONLY
By using this app, you agree that any dispute, complaint, claim, or
legal proceeding arising from any purchase made through the platform is
SOLELY between you (the customer or vendor) and the respective vendor
or customer.

This includes but is not limited to:
• Non-delivery of a product
• Wrong product delivered
• Damaged product received
• Product quality issues
• Price disputes
• Refund disputes
• Delivery delay or failure
• Fraud by vendor or customer
• Any physical, financial, or legal harm from a transaction

2.2 NO LEGAL ACTION AGAINST THE PLATFORM
By using this app, you explicitly agree that you WILL NOT initiate any
legal action, complaint, proceeding, or claim against:
• The platform (Sivasbazar / HelernexMkt)
• The developer Praveen Pushkin
• Any relatives, associates, or partners of Praveen Pushkin
• The website sivasbazar.com
• The mobile application

...for any dispute, harm, loss, or issue arising from any transaction
conducted through the platform. As the platform owner and developer, we
are not responsible for any conflict between a customer and a vendor.

2.3 VENDOR RESPONSIBILITY
Vendors (shop owners) are solely and fully responsible for:
• The accuracy of all product information they upload
• The quality and safety of all products they sell
• Compliance with all applicable local and national laws
• Payment of all applicable taxes on their sales
• Handling all delivery arrangements with customers
• Resolving all disputes with their customers
• Compliance with content restrictions of the platform

SECTION 3 — PROHIBITED PRODUCTS (GLOBALLY BANNED)
─────────────────────────────────────────────────────────────────────────────

3.1 The following products are BANNED on the platform globally:
• Alcohol, liquor, beer, wine, spirits, and all alcoholic beverages
• Tobacco, cigarettes, cigars, vapes, shisha, hookah
• Illegal drugs, narcotics, and controlled substances
• Weapons, explosives, and ammunition
• Adult content and pornographic material
• Counterfeit goods and pirated products
• Gambling products or services
• Hazardous or explosive materials
• Any product illegal under applicable law

3.2 REGIONAL BANS:
• PORK and all pork products are BANNED in all Gulf countries
  (Kuwait, UAE, Saudi Arabia, Qatar, Bahrain, Oman)
• BEEF and all beef products are BANNED in India EXCEPT Kerala and Tamil Nadu

3.3 VENDOR LEGAL RESPONSIBILITY FOR BANNED PRODUCTS
The platform uses automated detection systems to identify banned products.
These systems do not guarantee 100% detection. The existence of automated
detection does NOT transfer any legal responsibility to the platform or
its developer for any vendor's violation of these restrictions.

The vendor who uploads any product is SOLELY AND FULLY responsible for
ensuring their products comply with all applicable laws.

SECTION 4 — PLATFORM LIABILITY
─────────────────────────────────────────────────────────────────────────────

4.1 To the maximum extent permitted by law, the platform, its developer
Praveen Pushkin, and any associated parties shall NOT be liable for any:
• Transactions between vendors and customers
• Product quality, safety, or legality issues
• Non-delivery, wrong delivery, or delivery delay
• Payment disputes or fraud
• Physical, financial, or legal harm from any transaction
• Vendor uploaded content, including prohibited product uploads
• Data loss, platform downtime, or technical failures
• Any third-party claims arising from platform use

4.2 The platform is provided "AS IS" without warranty of any kind.

SECTION 5 — ACCOUNT AND CONTENT
─────────────────────────────────────────────────────────────────────────────

5.1 You must be 18 years or older to register or use this app.

5.2 You must not upload nudity, drugs, or prohibited content as profile
images or product images.

5.3 The platform reserves the right to suspend or terminate any account that:
• Uploads prohibited products or content
• Violates these Terms and Conditions
• Engages in fraudulent or illegal activity
• Abuses the platform in any way
This can be done immediately and without prior notice.

5.4 After account suspension, all products, store listings, and content of
the suspended account will be immediately hidden from customers.

SECTION 6 — FUTURE SALE OF PLATFORM
─────────────────────────────────────────────────────────────────────────────

6.1 The platform may in future be sold, transferred, or acquired.
In that event, user data may be transferred to the new owner.

SECTION 7 — GOVERNING LAW
─────────────────────────────────────────────────────────────────────────────

7.1 These Terms are governed by the laws of India, Kerala, Alappuzha District.
Any disputes relating to these Terms shall be subject to the jurisdiction
of the courts of Kerala, Alappuzha District, India.

SECTION 8 — ACCEPTANCE
─────────────────────────────────────────────────────────────────────────────

8.1 By using this app, you:
• Confirm you are over 18 years of age
• Have read and understood these Terms and Conditions
• Have read and understood the Privacy Policy
• Agree not to initiate any legal proceeding against the platform or its developer
• Accept that all transaction disputes are between you and the respective
  vendor or customer only
• Consent to your data being transferred in the event of a future platform sale
